Third‑party advertising refers to any advertisement or communication that is produced independently of a candidate or their campaign, that seeks to support or oppose a candidate, or to encourage a “yes” or “no” vote on a ballot question.
Third‑party advertising must be conducted entirely separate from a candidate’s campaign. Any materials created, distributed, or directed by a candidate or their campaign team are considered part of the candidate’s official campaign activities, not third‑party advertising.
This form of advertising allows individuals or organizations outside a campaign to express their views on candidates or ballot issues and to attempt to influence voter decision‑making.
A third‑party advertisement may appear in broadcast, print, electronic, or any other medium, and includes any content that promotes, supports, or opposes a candidate or a particular response to a ballot question. This encompasses traditional advertisements as well as materials such as brochures, signs, and similar communications.
